Terms and Conditions

These Terms of Use (the “Terms”) are a legally binding agreement between you and the operator of PaisaKhoj (“PaisaKhoj”, “we”, “us” or “our”) for your use of paisakhoj.com and any related pages, calculators, tools and content (together, the “Site”). They are also the rules and regulations and user agreement that an intermediary must publish under Rule 3(1)(a) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

By accessing or using the Site you confirm that you have read, understood and accepted these Terms, together with our Privacy Policy, Disclaimer, Affiliate and Advertising Disclosure, Cookie Policy and Grievance Redressal pages, all of which form part of this agreement. If you do not agree, please do not use the Site.

This agreement is an electronic record under the Information Technology Act, 2000 and the rules made under it. It does not need any physical or digital signature.

You must be at least 18 years old and capable of entering into a binding contract under the Indian Contract Act, 1872 to use the Site. The Site is not directed at children. If you are under 18, please use it only with a parent or legal guardian, who accepts these Terms on your behalf.

The Site is intended for people in India and is about products available in India. You are responsible for compliance with the laws of the place from which you access it.

PaisaKhoj is an independent information and comparison website. It records what banks, housing finance companies, NBFCs and other providers publish about their products, and offers calculators and explanatory articles.

PaisaKhoj is not a bank, a lender, a non-banking financial company, a payment aggregator, a credit information company, an insurer or insurance intermediary, a stock broker, investment adviser, research analyst or portfolio manager, a tax adviser, a lawyer or a chartered accountant. We are not registered with, licensed by, or authorised by the Reserve Bank of India, SEBI, IRDAI, PFRDA or any other regulator, and nothing on the Site should be read as suggesting that we are.

We do not accept, process or approve applications, we do not lend or arrange loans, we do not issue or sell any financial product, and we do not receive your money. When you click an apply link, you leave the Site and deal directly with the provider under that provider’s own terms. We are not a party to any contract between you and a provider.

Everything on the Site is general information. It is not personal financial, investment, credit, tax, insurance or legal advice, an offer, a solicitation, a recommendation to buy or apply for any product, or a guarantee of approval, credit limit, interest rate, reward value or benefit. A product described as suitable for a type of person is a generalisation and may not suit you.

You alone decide whether to apply for any product. Before doing so, read the provider’s own Most Important Terms and Conditions (MITC), schedule of charges, key fact statement and application terms, and take independent professional advice where appropriate.

We take reasonable care to record provider information accurately and to show the source and the date it was last checked. But fees, interest rates, rewards, eligibility, offers, partnerships and product availability are set by providers and can change without notice, and there may be delays, transcription mistakes or omissions on our side.

The provider’s own current published terms always prevail over what is shown on the Site. Where information is missing it is shown as not available or as not stated by the issuer; it should never be read as a zero, a waiver or a guarantee. We give no warranty that any information is complete, current or error-free.

Images, names, logos and descriptions of cards are shown only to help you identify the product. A card’s design, network, variant or benefits may differ from what is pictured.

Calculators produce estimates from the figures you enter and the stated assumptions. They are illustrations, not quotes, offers, credit assessments or predictions, and they cannot tell you whether a provider will approve you. Actual results depend on the provider’s terms, your credit profile, taxes, charges and other factors we cannot see. You are responsible for checking the inputs and the result before relying on them.

You agree to use the Site lawfully and in accordance with these Terms. You must not:

• breach any law, including the Information Technology Act, 2000, the Indian Penal Code or Bharatiya Nyaya Sanhita, 2023, the Digital Personal Data Protection Act, 2023, the Copyright Act, 1957 and the Trade Marks Act, 1999;
• host, upload, transmit or share through the Site (including its contact form) anything that is defamatory, obscene, pornographic, invasive of another’s privacy, hateful, harassing, misleading, infringing, harmful to minors, threatening to India’s unity, integrity, defence, security or public order, or that impersonates another person or carries malicious code, as listed in Rule 3(1)(b) of the Intermediary Rules;
• send us another person’s personal data, financial credentials, card numbers, CVV, OTPs, passwords or identity numbers. We never ask for these. If someone claiming to be PaisaKhoj asks for them, do not respond and tell us;
• scrape, crawl, copy at scale, mirror, frame or systematically extract the Site’s data or content, or use it to build a competing database, without our prior written permission;
• interfere with, overload, probe, test or attempt to gain unauthorised access to the Site, its servers or networks, or bypass any security or access control;
• use the Site, its data or its calculators to mislead consumers, or present our content as your own or as endorsed by us;
• use automated means, bots or AI systems to extract content for training or commercial redistribution without a written licence.

We may remove or disable access to content or suspend or restrict access to the Site, without notice, where we believe these Terms or the law have been breached, or where required by a court or government order.

The Site contains links to providers and other third-party sites. We do not control, endorse or monitor them and are not responsible for their content, products, availability, security, privacy practices or terms. Visiting a third-party site is at your own risk and is governed by that site’s terms and policy.

Provider names, logos, card images and trademarks belong to their respective owners. They are used on the Site only to identify the products described, as a matter of nominative reference. Their use does not mean the owner sponsors, endorses or is affiliated with PaisaKhoj. If you are a rights holder and want an image removed or corrected, write to us using the details on the Grievance Redressal page and we will act promptly.

PaisaKhoj may earn a commission or fee from some providers or affiliate networks if you reach a provider through a link on the Site and later take a product. This is explained in the Affiliate and Advertising Disclosure. A commercial relationship does not change what you pay and does not change how we record, score or describe a product.

All original content on the Site, including text, structure, selection and arrangement of data, scoring methodology, calculators, software, graphics and design, is owned by PaisaKhoj or its licensors and is protected by the Copyright Act, 1957 and other laws. Provider data that is published by providers remains theirs.

You may view the Site and print or share individual pages for your personal, non-commercial use, with attribution and a link to the original page. Any other reproduction, distribution, adaptation or commercial use needs our prior written consent.

If you send us feedback, corrections or other material, you grant us a non-exclusive, worldwide, royalty-free, perpetual licence to use it to operate and improve the Site, and you confirm that you have the right to do so.

To the fullest extent permitted by law, the Site and everything on it are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of accuracy, completeness, timeliness, merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that the Site will be free from viruses or harmful components or that defects will be corrected.

To the fullest extent permitted by applicable law, PaisaKhoj, its owner, proprietors, partners, directors, employees, contributors and service providers shall not be liable for any direct, indirect, incidental, special, consequential, exemplary or punitive loss or damage, including loss of money, profit, data, goodwill, credit opportunity or reputation, arising out of or in connection with:

• your use of, or inability to use, the Site;
• reliance on any information, calculator result, ranking, rating, score or content on the Site;
• any decision to apply for, accept, use, reject or cancel any financial product, or any act or omission of a provider, including fees, charges, interest, rejection of an application, mis-selling or service failure;
• errors, omissions, delays or outdated information;
• unauthorised access to or alteration of your data, or any virus, outage or cyber-incident; or
• any third-party site or link.

Where liability cannot be excluded, our total aggregate liability to you for all claims relating to the Site shall not exceed ₹1,000 (Rupees one thousand only).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or wilful misconduct, or any right you have under the Consumer Protection Act, 2019. If any part of this clause is held unenforceable, it applies to the maximum extent allowed.

You agree to indemnify, defend and hold harmless PaisaKhoj and its owner, personnel and service providers from any claim, loss, liability, penalty, damage and reasonable legal cost arising from your breach of these Terms or of any law, your misuse of the Site, content or material you submit, or your infringement of any third party’s rights.

To the extent PaisaKhoj acts as an intermediary, it relies on the protection of Section 79 of the Information Technology Act, 2000. On receiving actual knowledge through a court order or a notification from an appropriate government agency, or a valid complaint, we will act as the Intermediary Rules require.

Complaints about the Site, content, privacy or data protection, and requests to correct or remove content, are handled by our Grievance Officer. The contact details, the 24-hour acknowledgement and the 15-day resolution timeline are on the Grievance Redressal page.

We may modify, suspend or discontinue all or part of the Site, any feature or any content at any time without liability. Provisions that by nature should survive, including intellectual property, disclaimers, limitation of liability, indemnity, governing law and dispute resolution, survive termination.

We are not liable for any failure or delay caused by events outside our reasonable control, including natural disaster, epidemic, war, riot, strike, government or regulatory action, power or internet failure, failure of hosting, cloud or telecom providers, or cyber-attack.

We may update these Terms from time to time to reflect changes in law, regulation or our practice. The “Last updated” date below shows the latest version. Material changes will be flagged on the Site. Your continued use after an update means you accept the revised Terms.

These Terms are governed by the laws of India. Before starting any proceeding, you agree to first raise the matter in writing with our Grievance Officer and allow 30 days for resolution.

Any dispute that is not resolved in that period shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996 by a sole arbitrator appointed by PaisaKhoj and acceptable to you, or, failing agreement, as the Act provides. The seat and venue of arbitration shall be in India and the language shall be English. This clause does not affect any right you have as a consumer to approach a Consumer Commission under the Consumer Protection Act, 2019, or any statutory remedy that cannot be waived.

Subject to the above, the courts in India at the place of the operator’s registered office have exclusive jurisdiction.

These Terms, with the policies they refer to, are the entire agreement between you and us about the Site. If any provision is unenforceable, the rest remains in force. Our failure to enforce a right is not a waiver. You may not assign these Terms; we may assign them to a successor of the business. Notices to you may be given by posting on the Site or by email if you have written to us. Headings are for convenience only.
